Drug-free Workplace Policy

State workplace drug, alcohol, and marijuana testing laws are a complex maze of statutes, regulations and court decisions. As a result, employers and service providers are being sued for not following state-specific laws. There are more than 600 state laws and regulations as well as 10,000+ court and agency decisions that impact private workplace drug testing programs. These laws change frequently and if you do not remain current and in compliance you are at high risk of litigation, personal claims, impact of reputation, higher Workers’ Compensation premiums, along with other financial penalties. Having a drug-free workplace is essential to the success of any business. Soteria Screening Laboratories has partnered with the experts when it comes to writing policies. Together we can help you implement a customized drug-free workplace program tailored to your company's needs. Click here for more information!

At a minimum the written policy should include the following:

  • Rationale in regards to laws, regulations, and organizational goals.
  • Expectations for compliance explaining who, what, where, and when.
  • Options offered for assistance such as Employee Assistance Programs (EAP's), Substance Abuse Professionals (SAP's), or community resources.
  • Consequences for violating the policy.

Soteria’s goal is to assist you, the employer, in developing a Drug Free Workplace policy that is compliant with state laws, which in turn will give you basis to defend wrongful termination claims.

Employee Education

Drug Testing Compliance

Employee education is essential in preventing substance abuse in the workplace that could result in liabilities such as injuries, or other safety and financial consequences. You also want your employees to know that you support them and their health, and that help is available for individuals suffering from drug or alcohol abuse. It is important for employees to know the harmful effects of substance abuse and how it can affect not only their own safety, but the safety of their co-workers and possibly even customers. Among many of our training courses we offer, our most popular for employee education are:

"Drug and Alcohol Awareness for Employees" and "DOT Drug and Alcohol Awareness for Employees"

Supervisor Training

Supervisor training is essential in maintaining safe working conditions. If your leadership team is not properly trained, then they are insufficiently equipped to recognize the signs and symptoms of an employee under the influence of alcohol or drugs. Soteria offers customized supervisor training that takes into consideration the particular characteristics of your workplace. This is strongly recommended in order to maximize the effectiveness of your drug-free workplace policy and program.

Our training program will teach you:

  • How to be aware of legally sensitive areas.
  • How to recognize potential problems.
  • How to document in a systematic and fair manner.
  • How to act in a confidential way.
  • How to refer to appropriate services.
  • How to go about employee reintegration into the workplace.

Among our most popular Supervisor/DER training programs the three most popular are:

"Reasonable Suspicion Training for Supervisors (Non-DOT)"

"DOT Reasonable Suspicion Training for Supervisors"

"DOT Designated Employer Representative (DER) Training"

We offer online training for anytime access or if you prefer, live training in your workplace call (202) 679-6670. For more information about our virtual training programs click here.

Substance Abuse Professionals

Substance Abuse Professionals (SAPs) are a necessity for providing support and rehabilitation options for employees who violate a drug or alcohol regulation. Soteria can provide a readily available SAP listing as part of your company's drug-free workplace program. SAP represents the major decision point an employer may have in determining an employee's ability to return to work. To find a SAP near you click here or call Soteria for assistance.
